Terms of Service

These terms govern your use of MarioSMS. By creating an account, depositing a balance, or buying an activation, you agree to them. If you do not agree, do not use the service.

Who we are

MarioSMS is operated by Mario Digital Services Limited, registered at Unit 1208, 12/F, Tern Centre Tower One, 237 Queen's Road Central, Sheung Wan, Hong Kong, company number 3267810. "We", "us", and "MarioSMS" mean this company. "You" means the natural person or legal entity that holds the account.

What the service does

We rent phone numbers from our suppliers and let you receive a one-time SMS, voice, or flash-call verification code on those numbers. The number is allocated for a single verification window and is then returned to the supplier pool.

We do not control which services you choose to verify with these numbers, and we cannot guarantee that any particular third-party service will accept any particular number.

Eligibility

You may use MarioSMS only if you are at least 18 years old, have legal capacity to enter into a contract, and are not in a jurisdiction subject to comprehensive sanctions by the United States, the European Union, the United Kingdom, or the United Nations, and not on any government denied-party list. We may refuse service to anyone, at any time, for any lawful reason.

Your account

You are responsible for keeping your credentials secure. Every action taken through your account is treated as taken by you. Tell us immediately if you suspect your account has been compromised. One person is entitled to one account; using multiple accounts to evade limits or KYC requirements is grounds for termination.

Acceptable use

Use of MarioSMS is subject to our Acceptable Use Policy. That policy is part of these Terms. Violating it allows us to suspend or terminate your account, refuse refunds where the violation justifies it, and (if the conduct is unlawful) refer the matter to the relevant authorities.

Payment, top-ups, and refunds

We accept USDT (TRC20) for balance top-ups. On-chain settlement is final; reversing a USDT payment is not technically possible. We do not charge subscription or recurring fees; you pay only when an activation succeeds, and we automatically refund unsuccessful activations to your balance. Prices shown in your account are the prices you pay; we do not add surprise fees at checkout. Network fees for blockchain deposits and withdrawals are paid by the network and are not retained by us.

Identity verification

For certain service-and-country combinations we are required by law or by our suppliers to verify your identity. We will tell you before you spend if verification is required. We use a third-party provider (Veriff) for verification, and we receive a result rather than the underlying documents — see our Privacy Notice for details.

Intellectual property

The MarioSMS website, brand, copy, and software are our property. You may use them only as needed to use the service as a customer. You may not scrape, redistribute, rebrand, or sublicense the service without our written permission.

Disclaimers

To the extent permitted by law, MarioSMS is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, that any specific number will arrive in stock when you want it, or that any particular third-party service will accept the number you rent. We are not responsible for the actions of third-party services or for decisions those services make about codes delivered through our numbers.

Limitation of liability

To the maximum extent allowed by applicable law, our total aggregate liability to you for any claim arising out of or relating to the service is limited to the greater of: the total amount you paid to MarioSMS in the 12 months preceding the event giving rise to the claim, or USD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data, even if foreseeable. Nothing in these Terms excludes liability that cannot lawfully be excluded under your local consumer law (for example, statutory rights of UK and EU consumers).

Indemnification

You agree to indemnify and hold us harmless from any claim or demand made by a third party arising out of your violation of these Terms, the Acceptable Use Policy, or any applicable law.

Termination

You can stop using the service at any time. We can suspend or terminate accounts for violations of these Terms, suspected fraud or abuse, or where required by law. If we terminate your account without cause, we will return your unspent balance.

Changes to these Terms

We may update these Terms from time to time. Material changes are flagged on your next sign-in. Continued use of the service after a change means you accept the new Terms.

Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, excluding its conflict-of-laws rules. Any dispute will be brought in the courts of Hong Kong SAR, unless mandatory consumer-protection law in your country of residence gives you the right to sue locally — in which case that right is preserved.
